OGDEN AIRPORT IN COURT FIGHT WITH AIRPORT ASSOCIATION

The court battle between Ogden-Hinckley Airport (OGD) and the Ogden Regional Airport Association heated up a notch in November when attorneys for Ogden City filed two documents with the court – one requesting the court to rule immediately on the city’s motion to dismiss the case and the other in opposition to the Association’s motion for an injunction and temporary restraining order.

The dispute began in 2016 when the airport updated its master plan to put it on the path to a more solid financial footing. The plan included revised provisions affecting long-running leases that the Association felt were unfair and that it strongly opposed. Numerous discussions and negotiations were held but were unsuccessful in resolving the disagreement. The Association eventually filed a lawsuit last spring complaining that the airport’s new management plans would allow the city to illegally take possession of improvements built into hangars when leases are not renewed. The city denied the allegation and the Association subsequently sought to enjoin the city from terminating any leases before the suit is resolved. The city opposes the injunction on the grounds that it would prevent the city from managing the airport in a manner consistent with its municipal, state, and federal regulatory and statutory requirements.
